Actually the prohibition agains "divulging" predates the ECPA by more than half
a century, and goes all the way back to the Communications Act of 1934... in its
current form it's at

I lnow, "look at the Larry Gass case." BTDT, and no other court anywhere - nor
the Congress - has found it compelling enough to cite it as precedent for
anything ever since. Everyone (except some scanner buffs) seems to feel it's
either irrelevant or not a persuasive decision.
