While I can't say exactly how they assign their frequencies, I am certain
that the list that was in MT was a list of "nationwide" frequencies, but
that doesn't mean that they will all be used everywhere. Each operating
area will have some repeater and simplex frequencies assigned for it's use,
depending on what it's needs are.

As I said, the list is nationwide in that it is list of frequencies
assigned for use all across the US, but they may be used by others in
certain areas. In that case, the NTIA Spectrum Planning office may tell DHS
that in Philly don't use 165.4375 for a repeater. I'm sure there are more
than a few of these frequencies that may have other users in some areas.
The only way to confirm which of these frequencies is actually in use in
your area is to give them a listen for a while. I don't think you'll find
ALL of the BICE frequencies in use in any one area of the country...
