Well military frequencies have always been designated at least 'FOR OFFICIAL 
USE ONLY" even before "9/11".. CAP is operating on USAF frequencies, and 
should have been following the guidelines all along rather than publically 
posting on websites frequencies, repeater sites, etc.

My understanding, is that Civil Air Patrol cadets are not permitted to fly 
and or support CAP law enforcement (aka DEA) missions.

Personally, I just don't think withholding these frequencies are such a big 
thing.  Most hobbyists know how to put their scanners (or HF receivers) in 
"search mode", checking certain frequency ranges to find those "unknown & 
"protected"" frequencies.  Also with relatively inexpensive new breed of 
scanners with  "signal stalking" and/or "close call capture", it adds 
another relatively easy way to find these frequencies.

As far as MARS traffic goes -- frankly I think they've become "irrlevant" in 
current planning.  Much of the HF ops can be conducted with a portable 
satellite phone and/or data terminal rather than HF...   Not even sure if 
MARS really does very much morale phone patching anymore.....   Again 
federal HF, IMHO is more of a backup system rather than a primary system...

Again, I think the average hobbyist monitoring from a fixed home location 
wouldn't face any close encounters with law enforcement.. Of course those 
engaged in "on scene" monitoring/observation activities, ALWAYS face the 
possibility of law enforcement "encounters"  -- that's just the way it 
is!!!!
