Hello Jordan & the group:

I've got to wonder how you would know that tail# was up in the area since 
CAP does not have aircraft equipped with transponders that transmits Mode S 
Id's.

It's HIGHLY unlikely that CAP would be involved with the FBI, (which is a 
law enforcement agency).  CAP is prohibited by internal regulations & 
federal law from direct law enforcement activities to include suveillance. 
Generally FBI type JENA flights are surveillance in nature.  CAP is allowed 
under their current regulation to perform reconnaissance type activities. 
Recon is defined as flying over an area at "a point in time" and observing & 
reporting.  It does not include loitering over an area, nor does it mean 
following a particular vehicle or person, which would be consider 
surveillance type operations.

 The CAPFLIGHT callsign is required to be used on CAP flights/missions BUT 
there may be some waiver authority when the external "customer" CAP is 
supporting requests it (see CAPR 100-1, paragraph 7-13d (1) & (2) 
http://level2.cap.gov/documents/R100_001.pdf)    Frankly I would think that 
a tactical callsign offers more security than transmiting ones tail number 
on an aircraft that can be readily observed.
