So FBI surveillance is in the clear? 

In the Bay Area, I caught some surveillance on Santa Clara's County DMR. In the dark ages, the police would use the tech company repeaters for surveillance. HP in particular. 

Security by obscurity is fine when your target isn't very tech savvy. You have to listen to a lot of boring DMR to catch an "off label" use.

I think most of the conversation has gone to newer tech like RadioReference
and Facebook groups.

Its also my understanding most agencies have gone to cellphones for
everyday comms and some of the agencies that do still use radios are now
encrypted.

Here in Las Vegas, FBI and USMS comms, with the exception of surveillances,
are now encrypted. DHS FPS is still in the clear. I no longer hear TSA, but
its likely just my location. BLM and NPS is still in the clear. USFS and
NIFC has changed several freqs, HTF Forest Net is now on 172.2750.
