The whole illegal / legal thing got *very* blown out of proportion back
in the good old days. People got very paranoid about what they could
and could not use on the ham bands.
When things like PSK31 started to show up the FCC actually clarified
the rules as they apply to "codes" on the ham bands. Based on that
clarification things are not as bad as a lot of people thought. You can
use any commonly accepted, published data format as long as the
intention is not to obscure the content of the transmission.
Bottom line, if you can find it in a book as a standard 5 level code
you can use it on the ham bands. I suspect that changing the code you
use every five characters might fall under the "obscuring the content"
rule though.
