It depends. You as a builder can make what ever you want.
If you engage in SELLING it, you need to pass "Type Acceptance."

Type acceptance for Amateur radio gear is different from that
required for commercial/business/public safety stuff.

That the Baofang will transmit in the entire spectrum it needs
the correct type acceptance.

If you do a web search on just about any piece of Amateur
radio equipment, you'll find modifications to allow it to
transmit outside of the Amateur bands.

Case in point, buy a Kenwood 2 meter Amateur radio, clip a
diode or two and set it up to use for the local police.
Instant FCC Type acceptance violation.

Another example, modifying a Motorola radio type accepted
for use by the police so it includes Amateur frequencies. Also
a type acceptance violation.

Of course, the general mindset of a very large number of
Amateur radio operators is "But I need to cover DC to Daylight
in case of, you  know, an emergency."
